Terms of Service

These Terms of Service govern your use of Hudson Valley Wireless internet services, managed Wi-Fi, and Dedicated Internet Access (DIA). By subscribing to or using our services, you agree to be bound by these terms. Please read them carefully before using our services.

Service Terms

Hudson Valley Wireless provides fixed wireless internet, managed Wi-Fi, and Dedicated Internet Access services. Service availability depends on line of sight to our tower network and geographical coverage. All equipment used to deliver service remains the property of Hudson Valley Wireless and must be returned upon termination. Service plans, pricing, and features are subject to change with 30 days advance notice to subscribers.

Billing and Payment

Services are billed monthly in advance on the first day of each billing cycle. The first month's charges are prorated from the installation date. A late fee of $5.00 is applied for payments not received by the due date. Accounts past due for more than 15 days may be suspended. A reconnection fee of $25.00 applies for suspended accounts. Accounts inactive for 90 or more days may be permanently disconnected, requiring a $250.00 reactivation fee.

Subscriber Obligations

Subscribers agree to use services for lawful purposes only and in compliance with all applicable federal, state, and local laws. Subscribers must maintain account security, keep personal information current, not tamper with or relocate HVW equipment, and provide reasonable access to premises for installation and maintenance. Subscribers are responsible for all activity on their account, including activity by other users of their connection.

SMS/Text Message Consent

By providing your phone number, you consent to receive account-related SMS and text messages from Hudson Valley Wireless. Messages may include service alerts, billing notifications, maintenance updates, and support communications. You may opt out at any time by texting STOP. Text HELP for support information. Standard message and data rates may apply. Your phone number will not be sold or shared with third parties for their marketing purposes.

Limitation of Liability

Hudson Valley Wireless's total liability for any claim arising from service is limited to one month's service fee. We are not liable for indirect, incidental, special, consequential, or punitive damages. We are not liable for service interruptions caused by weather, power outages, equipment failure, acts of nature, or circumstances beyond our reasonable control.

Termination

Subscribers may terminate service with 30 days written notice via email, fax, or US mail. Phone calls alone are not sufficient for cancellation requests. Hudson Valley Wireless may terminate service immediately for violations of these terms. All HVW equipment must be returned in good working condition within 30 calendar days of termination. Early termination fees of up to $350.00 may apply for term contract plans.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without reference to conflict of laws principles. Any disputes arising from these terms shall be filed in the courts of Albany County, New York.
