Open Internet Compliance Statement
John R. Guzzo LLC d/b/a Hudson Valley Wireless ("HVW") provides Broadband Internet Access Service and is committed to maintaining the Internet as an open platform for innovation, investment, economic growth, and free expression. This Open Internet Compliance Statement describes HVW's policies and practices regarding broadband Internet access service, including network management practices, performance characteristics, and commercial terms.
Our Open Internet Principles
HVW supports transparency, no blocking of lawful Internet content, no throttling of lawful Internet traffic, no unreasonable discrimination, no paid prioritization, and the freedom of subscribers to access lawful content, use non-harmful applications, attach non-harmful devices, and customize their service experience based on selected plans. HVW's broadband access service is primarily a fixed wireless service. Because of the nature of fixed wireless networks, certain conditions may affect speed and quality of service, including foliage, line-of-sight obstructions, distance from the transmission point, RF interference, weather, and the number of devices connected at a subscriber location.
Network Management Practices
Except for reasonable network management and lawful security measures, HVW does not block access to lawful content, applications, services, or non-harmful devices. HVW does not throttle or otherwise impair lawful Internet traffic on the basis of content, application, service, user, or use of a non-harmful device. HVW does not favor traffic from its affiliates over other Internet traffic. HVW does not directly or indirectly favor some traffic over other traffic in exchange for monetary or other consideration. During periods of unusually high demand, HVW may use reasonable congestion management practices designed to ensure fair access to available bandwidth.
Performance Characteristics and Commercial Terms
HVW publishes current descriptions of broadband Internet access services offered to residential and business subscribers, including pricing, expected speeds, expected latency, and suitability for real-time applications. All pricing is based on enrollment in automatic payments unless otherwise stated. HVW does not offer data-related Specialized Services that materially reduce the last-mile capacity available for broadband Internet access service.
FCC Requirements and Complaint Process
The Federal Communications Commission has adopted rules intended to preserve the Internet as an open platform. If a subscriber believes HVW is not complying with applicable FCC rules, the subscriber may file an informal complaint with the FCC through the FCC consumer complaint process at consumercomplaints.fcc.gov.
